DWELLING POLICY PROGRAM AVAILABLE ENDORSEMENTS

Protection under the Insurance Services Office's (ISO) Dwelling Policy Program is designed for the "typical" dwelling exposure. Modifications provide customized coverage according to an individual's particular needs. ISO has a variety of endorsements and they generally require additional premium. ISO uses a common system to number its forms: two letters followed by a four-digit form number, then the form's edition month and year. For example, the current edition of the Dwelling Policy Basic Form is DP 00 01. The first two numbers represent the form category. We provide the following for your reference:

The Dwelling Policy Program has a handful of endorsements with unique numbering which fall outside of the above scheme. This article does not discuss any state-specific forms (Category 01).

PROPERTY ENDORSEMENTS

CATEGORY 00–COVERAGE FORMS

DP 00 08Modified Loss Settlement - Form DP 00 01 only

This form amends the Basic Form DP 00 01. The form's loss settlement provision is modified to handle claims on a repair cost or actual cash value basis. The form's reference to repairing or replacing does not contemplate expense due to a requirement to comply with construction-related laws/ordinances.

DP 00 21─Transition Endorsement For DP 00 01–Dwelling Property 1 - Basic Form

This form amends the DP 00 01, previous edition into a 07 14 edition form.

CATEGORY 03–DEDUCTIBLE ENDORSEMENTS

DP 03 12─Windstorm or Hail Percentage Deductible

This form modifies the policy deductible to respond differently in the event of a wind or hail loss. Should damage occur due to wind or hail, a deductible equal to a specified percent of the limit of insurance shown for Coverage A, B, D or E (whichever is the greatest amount) applies to the loss.

DP 03 33─Fungi, Wet or Dry Rot or Bacteria-Increased Amount of Coverage

This form modifies a portion of the policy’s “Other Coverages Section.” It results in providing coverage up to the amount shown in the endorsement’s schedule (or elsewhere in the policy). Coverage responds to damage created by fungus, rot or bacteria, removal of same, costs to tear out property to gain access to damaged areas, cost of testing to confirm elimination of fungus, rot, or bacteria. Regardless of the amount appearing in the schedule, total protection is capped at a maximum of $50,000.

DP 03 61─Hurricane Deductible

This form allows a special deductible to be applied to any hurricane loss to insured property. The form’s deductible is either the amount stated in the form’s schedule or a stated percentage that is applied to the highest limit that applies among the policy’s Coverage A, B, D or E. The form also modifies the applicable policy’s definition of “state.” The definition of what constitutes a hurricane is part of the form.

CATEGORY 04–MISCELLANEOUS ENDORSEMENTS

DP 04 11─Automatic Increase in Insurance

This form automatically increases the insurance limit for Coverages A and B per a percentage that is shown on the policy declarations page.

DP 04 14─Additional Living Expense - Form DP 00 01 Only

This form is used to add Additional Living Expense to the Basic Form Dwelling Policy.

DP 04 17─Trees, Shrubs and Other Plants - Form DP 00 01 Only

This endorsement may be used to add coverage for trees, shrubs, plants, and lawns to the Basic Form Dwelling Policy. A maximum of $500 coverage applies to a single item. The form includes an option to indicate whether a wind/hail deductible applies.

DP 04 18─Windstorm or Hail Broad Form and Special Forms

This form may be purchased to extend the coverage available under the DP 00 02 and DP 00 03 for trees, shrubs, and plants to include losses caused by windstorm or hail. The coverage pays a maximum of $500 for any single tree, plant, or shrub. The maximum limit of insurance for all such property is 5% of the Coverage A insurance limit. Finally, coverage under the endorsement is now additional insurance (does not reduce the Coverage A limit).

DP 04 19─Windstorm or Hail - Radio and TV Antennas, Awnings and Signs

This form may be purchased to extend the coverage available under all forms of the Dwelling Policy Program for antennas, aerials, wiring, awnings, or signs to include losses caused by windstorm or hail.

DP 04 20─Permitted Incidental Occupancies

This form may be purchased to extend protection under Coverage C - Personal Property to cover personal property that is connected with the described, incidental business occupancy.

DP 04 22─Limited Fungi, Wet or Dry Rot, or Bacteria Coverage

This is a restriction of coverage disguised as a coverage enhancement. It expands the wet and dry rot exclusion to also exclude fungi and bacteria and moves it out of the less restrictive Coverage A and B exclusion to the more restrictive General Exclusions. It provides a scheduled amount of coverage for building property that has been damaged by the excluded items but only when a covered peril initiates that loss. The limit is an annual aggregate amount over all locations and claims made on the policy.

DP 04 30─Premium Sharing Two or More Policies

This form may be purchased when the coverage written for the covered property is shared by more than one policy. Under this endorsement, the insured agrees to maintain the specified total amount of coverage. Further, the endorsement limits the coverage under the policy to be the lesser of its proportion of coverage or the limit shown on the declarations. The form replaces Condition 9, Other Insurance.

DP 04 31─Improvements, Alterations and Additions

This form may be purchased in order to write separate coverage under the DP 00 01, DP 00 02 or DP 00 03 for improvements, alterations or additions made at the insured's expense. This supplements any coverage available in the "Other Coverages" section of the policy.

DP 04 32─Deferred Premium Payment

This form allows an insured to defer the payment of the total policy premium by dividing the payment into annual installments.

DP 04 37─Windstorm or Hail Exclusion

This optional endorsement may be added to a DP 00 01, DP 00 02 or, DP 00 03 to exclude coverage under Coverages A - Dwelling, B - Other Structures, or C - Personal Property for losses caused directly by windstorm or hail. Coverage D - Rental Value and, if applicable, Coverage E - Additional Living Expenses are unaffected by this exclusion.

DP 04 41─Additional Insured - Described Location

This form enables a company to cover a person or organization with an insurable interest in the building at the described location as an additional insured. The form also obligates the insurance company to send a separate notification to the additional interest of any intent to cancel or non renew the coverage

DP 04 58─Gravemarkers

This form provides a maximum of $5,000 protection against direct damage that a covered peril causes to a gravemarker or mausoleum at a described location.

DP 04 59─Assisted Living Care Coverage

This form adds a limited amount of personal property and additional living expense coverage for a described person at a described assisted living care facility. The coverage amount must be selected and sublimits apply to certain types of property such as hearing aids, eyeglasses, contact lens, wheelchairs, etc.

DP 04 63─Loss Assessment Property Coverage

Purchase of this form adds coverage for any assessment that is charged to the policy owner by a corporation or association of property owners. The assessment is only for losses to commonly held property and the loss must be due to a peril that is covered by the dwelling policy. Coverage under the endorsement does not apply when a loss is caused by volcanic eruption or earthquake. A $250 deductible applies.

DP 04 65─Special Coverage

This endorsement provides risk of direct physical loss coverage to improvements, alterations and additions and unit-owners building items. The same exclusions that are found in the DP 00 03–Dwelling Property 3 - Special Form applies to these classes of property.

DP 04 68─Loss Assessment Coverage for Earthquake

Purchase of this form adds coverage for any assessment that is charged to the policy owner by a corporation or association of property owners. The assessment is only for losses to commonly held property and the loss must be due to earthquake including land shock waves or tremors before, during or after a volcanic eruption. Coverage under the endorsement does not apply when an assessment is made by a governmental body. Neither is there coverage for losses caused by flooding or tidal waves. A minimum of a $250 deductible applies.

DP 04 69─Earthquake

This provides coverage for direct loss under Coverage A, B and C caused by earthquake including land shock waves or tremors before, during or after a volcanic eruption, but does not include the cost of filling land. There is NO coverage for losses caused by flooding or tidal waves, nor is there any coverage for loss to masonry veneer. A minimum of a $250 deductible applies.

DP 04 70─Premises Alarm or Fire Protection System

When this form appears on the policy declarations, a premium credit has been allowed because of the additional protection which exists at the dwelling. The insured must keep the system in good working order.

DP 04 71─Ordinance or Law Coverage - Increased Amount Of Coverage - DP 00 02 and DP 00 03 Only

This form increases the amount of coverage applicable under Other Coverage 12. Ordinance or Law.

DP 04 72─Broad Theft Coverage

DP 04 74─Ordinance or Law Coverage - Form DP 00 01 Only

This provides a limited amount of coverage under a DP 00 01 to either a dwelling owner or a tenant for increased costs incurred because of the enforcement of an ordinance or law that affects repairs or replacement of damaged property. The endorsement excludes coverage for any loss in value of the property that is caused by the ordinance or law. However, if applicable, coverage is excluded for any costs connected with monitoring or testing the property's compliance with any ordinance or law.

DP 04 75─Actual Cash Value Loss Settlement Windstorm or Hail Losses to Roof Surfacing

This form Modifies a DP 00 01 (that is endorsed with a DP 00 08 form), DP 00 02 or DP 00 03 so that the policy settles any windstorm or hail damage to a roof on an actual cash value basis. A premium credit is given when this form applies.

DP 04 76─Actual Cash Value Loss Settlement

When this endorsement is attached, all losses to covered property are settled on an actual cash value basis.

DP 04 85─Fire Department Clause (Subscription Contract Services)

This form requires the insured to maintain a contract with a privately owned fire department while the dwelling policy is in force.

DP 04 95─Limited Water Back Up and Sump Discharge Or Overflow Coverage

This modifies a dwelling policy to provide coverage for a loss caused by water which issues from a sewer or drain, or which overflows from a sump pump. There is no coverage to the sump pump itself. Coverage applies up to the amount shown in either the form’s schedule or elsewhere in the policy. As the form makes no specific reference to one, the policy’s deductible would apply to such losses.

DP 04 99─Sinkhole Collapse

This form provides for damage to covered property caused by Sinkhole Collapse. The form voids the applicable policy's Earth Movement exclusion as it relates to sinkholes.

CATEGORY 05 - ADDITIONAL COVERAGE ENDORSEMENTS

DP 05 28–Owned Motorized Golf Cart-Physical Loss Coverage

Optional form provides coverage (max. amt stated in the schedule or elsewhere) for damage to golf cart that is owned by the insured and which is adequately described.

DP 05 30─Functional Replacement Cost Loss Settlement (DP 00 02 and DP 00 03 Only)

This form modifies the dwelling policy loss settlement provision of the DP 00 02 and DP 00 03 to pay losses based on the cost of repair or replacement using adequate materials instead of materials or values that are equivalents to the damaged or destroyed property.

DP 05 31─Modified Functional Replacement Cost Loss Settlement (DP 00 02 and DP 00 03 Only)

This form modifies the dwelling policy loss settlement provision of the DP 00 02 and DP 00 03 to pay losses based on the cost of repair or replacement using adequate materials OR upon the actual cash value of the damaged or destroyed property, whichever amount is greater.

DP 05 37–Cap on Losses from Certified Acts of Terrorism

Form advises policyholders that the issuing company's obligation to respond to liability involving certified terrorist activity is limited by federal statute.

DP 05 38–Cap on Losses from Certified Acts of Terrorism; Disclosure Pursuant to Terrorism Risk Insurance Act

Form advises policyholders, in compliance with the disclosure provisions of TRIA, that the company is charging the listed amount for terrorism coverage, that their obligation for payment is limited by federal statute and that the federal government provides (via subsidy) additional amounts of coverage for terrorist acts. The form also advises the additional premium created by the use of this endorsement’s protection.

CATEGORY 11 - BUILDERS’ RISK ENDORSEMENT

DP 11 43─Dwelling under Construction

This form converts the dwelling policy to a builders' risk form. The Coverage A limit becomes provisional, continuously adjusting its limit to reflect the increasing value of the property as it is built. The premium for such coverage is significantly reduced because the charge is based upon the property's average value over the course of construction.

CATEGORY 12 - CHANGE ENDORSEMENTS

DP 12 10─Change Endorsement

CATEGORY 16 – WATER DAMAGE ENDORSEMENTS

DP 16 09─Water Exclusion

DP 16 13─Earthquake And Volcanic Eruption

Modifies a base DP Coverage form so that coverage is extended to damage caused by either earthquake or volcanic activity. The option exists to include protection for exterior masonry veneer. Coverage is subject to the deductive percentage in the form’s schedule.

CATEGORY 17 - CONDOMINIUM ENDORSEMENTS

DP 17 66─Unit-Owners Coverage

This optional endorsement may be used to modify the provisions under a DP 00 01, DP 00 02, or DP 00 03 to provide coverage to a condominium owner. The modification is accomplished by adding provisions for Unit-Owners Building Items, Other Insurance, Loss Settlement, Fair Rental Value and Additional Living Expense. This coverage is excess over any collectible, primary insurance including a service agreement.

DP 17 71–Unit-Owners Coverage-Modified Other Insurance & Service Agreement Condition

Withdrawn as of the 07 14 edition.

LIABILITY ENDORSEMENTS

DL 24 02─Additional Policy Conditions

This form adds the necessary additional conditions when the Personal Liability supplement is written as a standalone policy. It includes the following clauses: Liberalization, Waiver, Assignment, Death, and Cancellation.

DL 24 03─Personal Liability Schedule

This form is to list the insurance limits for Coverages L, Personal Liability and M, Medical Payments. It also has room for other insured locations.

DL 24 04─Additional Residence Premises Rented to Others

This provides coverage for additional covered residence premises, rented to others, owned by the named insured or spouse. The endorsement extends the definition of "insured premises" contained in the policy to include designated premises under Coverage L (Personal Liability Coverage).

DL 24 05─Business Pursuits

This endorsement provides coverage for the liability of an insured arising out of business activities, other than a business of which he is sole owner or a partner. Rates are shown in the Premium Section of the Homeowners Manual for: clerical office employees, salesmen, collectors or messengers, and teachers with and without coverage of liability for corporal punishment.

See the reference to DL 24 17 later in this article discussion for information on protection for day care providers. Refer to the company for rates applicable to other occupational classifications.

DL 24 06─Watercraft

This endorsement provides coverage for an outboard motor or combination of outboard motors of more than 25 total horsepower or for watercraft not basically covered under a Homeowners policy. Premiums are shown in the Premium Section of the Homeowners Manual for: each outboard motor less than 50 horsepower and for those 50 horsepower and over; inboard or inboard-outdrive motorboats; sailboats rated under 26 MPH, 26-40 MPH, and over 40 MPH; and sailboats with no auxiliary power from 26 to 40 feet in length.

This endorsement tracks with the basic liability policy exclusion of all inboard or inboard-outdrive motors. The endorsement excludes liability arising out of the use of watercraft involved in a pre-arranged or organized race or speed contest. It covers vicarious liability whether or not statutorily imposed.

DL 24 07─Owned Snowmobile

This extends coverage under Coverage L - Personal Liability and Coverage M - Medical Payments to Others to provide protection for losses arising out of the use of a snowmobile. In order to qualify for coverage, a loss has to occur away from an insured location and the vehicle must be described within the form of the policy declarations. However, coverage is excluded if the snowmobile is illegally used on a highway, is carrying people or property for compensation, is rented to others, or is being used in a “business” or in a race. A premium charge applies separately to each snowmobile and varies according to the limits of liability selected.

Complete coverage for snowmobiles, including Physical Damage insurance, may be arranged under a separate policy designed for snowmobiles and other recreational vehicles.

DL 24 09─Permitted Incidental Occupancies

Formerly entitled Office, Professional, Private School or Studio Use, this endorsement has been revised to complement the policy's business exclusion. The permitted occupancy, as well as the premises location, must be described either on the endorsement or elsewhere in the policy (or declarations page). Besides limiting liability coverage to the described occupancy, the endorsement also excludes coverage for "bodily injury" damages to any employee of the business and for any act involving corporal punishment.

DL 24 10─Additional Insured

This form allows the addition of another insured party for Coverages L, Personal Liability, and M, Medical Payments. However, there is no coverage when a loss or claim involves an insured’s employee (including a temporary substitute for such an employee). It also states that the additional insured will be notified in the event of cancellation or nonrenewal.

DL 24 11─Premises Liability

This endorsement provides premises liability coverage only. More than one location can be designated. The endorsement eliminates the necessity of relying on commercial forms and rates for this exposure.

DL 24 14─Loss Assessment Liability Coverage

This provides coverage for the insured being assessed for a covered bodily injury or property damage loss made by a corporation or property association. The form specifies that the limit of liability applies to each loss and that acts of directors, officers or trustees are considered a single act regardless of the number of persons involved. Coverage is not governed by the policy period condition.

DL 24 16─No Coverage for Home Day Care Business

Withdrawn with 07 14 edition.

DL 24 17─Home Day Care Coverage

This endorsement extends coverage to a day care business operated on the residence premises. IMPORTANT: the endorsement still excludes losses arising from physical or mental abuse. The Limit of Liability for this coverage is provided on an annual aggregate basis.

 

Example: Paula is covered by a DL 24 01 policy endorsed by a DL 24 17–Home Day Care Coverage endorsement. Her policy has a $100,000 limit of liability. In the 2nd month of the policy year, a child Paula is paid to care for falls from a highchair. The policy pays $30,000 for the resulting suit. For the remainder of the policy period, Paula has a maximum limit of $70,000 to respond to any additional loss involving a home day care exposure.

 

The pertinent manual rule provides a rate for the care of one to three persons other than insureds. The company has the discretion to determine eligibility and rating for larger exposures.

DL 24 27–Additional Insured-Student Living Away From The Residence Premises

Extends the dwelling liability's coverage to a student who is normally a member of the insured's household while that student is away at school. The individual and the school location must appear on the policy or the endorsement schedule.

DL 24 32─Incidental Low Power Recreational Motor Vehicle

This endorsement provides coverage for motorized equipment, except for motorized bikes, mopeds, or golf carts. Further excluded are conveyances that are capable of traveling faster than 15 mph, subject to vehicle registration, while carrying persons, in use in a “business,” rented to others or involved in a race.

This form’s coverage includes protection for persons to whom covered property has been entrusted as well as for losses vicariously involving the insured. An example of a covered conveyance would be a motorized wheelchair.

DL 24 34─Exclusion For Computer-Related Damage Or Injury

This form applies in situations involving Home Day Care, Permitted Incidental Occupancies or Business Pursuits Coverage. It excludes damage or injury related to computer date processing (Y2K) problems.

DL 24 35─Limited Coverage For Year 2000 Computer-Related And Other Electronic Problems

This form nullifies form DL 24 34–Exclusion for Computer Related Damage or Injury in order to arrange limited coverage for certain types of computer/electronics failure.

DL 24 67─Assisted Living Care Coverage

This extends coverage under Coverage L - Personal Liability and Coverage M - Medical Payments to persons named in the form’s schedule (or elsewhere). In order to qualify for coverage, the person must be a legal relative of an “insured” and must be a resident at an assisted living facility that is also described in the scheduled. Finally, the schedule includes the limit of insurance (Coverage L) for the facility resident.

DL 24 71─Limited Fungi, Wet or Dry Rot, Or Bacteria Coverage

This endorsement provides a sublimit for damage or injury related to mold, rot, fungus, or bacteria. The form provisions define fungus. It does not include similar items that are meant to be eaten, such as mushrooms. Therefore, the Personal Liability supplement is free to respond to loss involving food poisoning.

DL 24 79─Deferred Premium Payment

This form may be used with a monoline property or liability dwelling fire policy. It allows an insured to defer the payment of the total policy premium by dividing the payment into annual installments.

DL 24 82─Personal Injury

This endorsement expands liability coverage by modifying the definition of “bodily injury” to include “personal injury.” In other words, coverage is granted for injuries caused by an insured due to false arrest, detention, malicious prosecution (and related actions), libel (and similar actions), invasion of privacy, wrongful eviction, and wrongful entry.

The endorsement excludes personal injury:

·         suffered by an “insured”

·         caused by an insured who knowingly violates a law

·         which arises out of the insured’s employment or a “business”

·         arising out of a civic or public duty (when the insured receives compensation).

DL 24 87–Cap on Losses From Certified Acts of Terrorism

Form advises policyholders that the issuing company's obligation to respond to liability involving certified terrorist activity is limited by federal statute.

DL 24 89–Cap on Losses From Certified Acts of Terrorism; Disclosure Pursuant to Terrorism Risk Insurance Act of 2002

Form advises policyholders, in compliance with the disclosure provisions of TRIA 2002, that the company is charging the listed amount for terrorism coverage, that their obligation for payment is limited by federal statute and that the federal government provides (via subsidy) additional amounts of coverage for terrorist acts.

DL 24 96─Rating Information - Limited Lead and Escaped Liquid Fuel Liability and Property Remediation for Escaped Liquid Fuel Coverages

DL 24 97─Limited Lead and Escaped Liquid Fuel Liability and Property Remediation for Escaped Liquid Fuel Coverages

This endorsement contains the details on the named insured’s coverage selection for pollution-related losses. Specifically, it discusses losses for bodily injury or property damage caused by liquid fuel which escapes from a fuel system or for bodily injury or property damage caused by exposure to lead.

Either an additional premium charge or a premium credit may apply. The premium impact depends upon the extent of the escaped fuel and/or lead exposure that is identified as being applicable to the insured location. The parameters involve the amount of liquid fuel on the premises and whether it is stored above or below the ground or, for the lead exposure, the age of the insured dwellings. A credit applies when circumstances prove that the escaped fuel and/or limited lead exposures are either minimal or non-existent.

The form also provides limited coverage for the expense involved in restoring (in other words, remediating or repairing) damaged property. The coverage is further limited by its being offered on an annual aggregate basis. Either the deductible for any property coverage or a minimum of $250 applies to the coverage provided by this form. The form includes a schedule for listing the limits of liability for damages and remediation and a description of the insured location.

The form excludes coverage for:

·         Damage to the actual fuel system

·         Any loss in market (or pending sale) value to the covered real and/or personal property

·         The cost to replace any lost fuel

·         Damage caused by fuel that escapes from the tank of a motorized vehicle

DL 24 98─Limited Lead and Escaped Liquid Fuel Liability and Property Remediation for Escaped Liquid Fuel Coverages

This endorsement contains the details on the named insured’s coverage selection for pollution-related losses. Specifically, it discusses losses for bodily injury or property damage caused by liquid fuel which escapes from a fuel system or for bodily injury or property damage caused by exposure to lead.

DL 34 11–Canine Liability Exclusion Endorsement

This form is a named dog exclusion. Space is provided to enter a name and description of a dog. When attached, it eliminates BI and PD caused by the described dog. The exclusion applies to that dog whether it is owned as well as in the care, custody, or control of an insured.

Note: The form may be problematic to apply to non-owned animal situations. What would be the circumstances under which this endorsement would be executed for non-owned dogs? Further, how would enforcement be affected by a dog’s name change or an ambiguous description? A photo or micro chipping requirement may have made sense.

DL 34 12–Personal Injury Coverage (Aggregate Limit of Liability)

This endorsement adds coverage for personal injury. The form defines it as any injury arising out of false arrest, detention or imprisonment, or malicious prosecution; libel, slander, or defamation of character; invasion of privacy; or wrongful eviction or wrongful entry. It is identical to DL 24 82–Personal Injury Endorsement except for the addition of an aggregate limit of liability.

DL 34 13─Transition Endorsement

This form amends the DL 24 01, previous edition into a 07 14 edition form.
